IRS EIN online application error 101 indicates your business name is similar to another name in their database, and they won’t assign you an EIN. Your LLC is not impacted. Do not continue to submit the online application. Contact the IRS, fax Form SS-4 (about 4 business days), or mail Form SS-4 (about 4 weeks), per the IRS.
You filled out every screen, hit submit, and got an error message instead of a nine-digit number. Error message 101 is a name conflict. It is not a rejection of you, your company, or your state filing.
We see this error regularly. It usually causes founders to waste time because they repeatedly submit a form that cannot be completed once the name is flagged. We can explain what triggers it and the quickest way to get your EIN anyway.
What Does IRS EIN Online Application Error 101 Mean?
The online assistant compares the legal name you enter against entity names in the IRS database. If it identifies a name it believes is too close, it will stop, give you error message 101, and tell you to call or apply on paper.
Why the IRS Name Check Is Nationwide
The check is nationwide. Your Secretary of State will only check names registered in that state. “Summit Ridge Consulting LLC” may clear Wyoming, but collide with “Summit Ridge Consulting Inc.” in Ohio.
Names that contain the words Global, Apex, Prime, Solutions, Ventures, and Consulting collide most often. Swapping LLC for Inc. won’t help because the IRS looks at the core name.
Who Can Use the Online EIN Assistant
A final filter is applied. The online assistant is only available to applicants whose principal business is in the U.S. or its territories and whose responsible party has an SSN, ITIN, or existing EIN. It is open Monday to Friday, 7 a.m. to 10 p.m. Eastern. Non-resident founders without an SSN or ITIN never reach error 101 because they apply by fax, mail, or phone from the start. That is a normal route for non-residents with an LLC, not a workaround.
Does Error 101 Mean My LLC Name Is Not Available?
It doesn’t mean your LLC name is not available. In fact, your Articles of Organization have already been approved, and your LLC legally exists. Error 101 only blocks the instant EIN.
We have seen that the most expensive reaction to receiving error 101 is founders amending their name with the state right away. This means a new state fee (fees vary by state), a new approval wait, and a new SS-4 anyway. Send the SS-4 under your existing name first. Rename only if the IRS tells you that the name conflict cannot be cleared.
How Do I Fix IRS EIN Online Application Error 101?
Work through the following in order.
- Do not continually attempt the same name. You will receive the same result. Too many attempts can result in reference 105, which locks you out for approximately 24 hours. The IRS also allows only one EIN application per responsible party per day.
- Attempt a clean name only if you suspect a name entry error. Compare name entries character by character with your Articles of Organization, including commas and other punctuation.
- Call the IRS. The error screen says to contact the Business and Specialty Tax Line, 800-829-4933. Ask for reference number 101. Some agents can confirm your entity is separate and clear the hold. Others will direct you to fill out Form SS-4. Taking the call is a ten-minute attempt, not a long-term plan.
- Fax Form SS-4 if you want to take the shortest paper route. Domestic applicants fax to 855-641-6935, and applicants outside the U.S. fax to 304-707-9471. In either case, be sure to include a fax number on the cover page. Otherwise, the IRS has no way to return the EIN.
- Mail Form SS-4 if you do not have fax access. Send it to the Internal Revenue Service, Attn: EIN Operations, Cincinnati, OH 45999. The IRS recommends filing at least 4 to 5 weeks before you need the EIN.
What Does It Cost and How Long Does It Take? (as of November 2026)
The IRS charges nothing for an EIN, regardless of the method. Anyone charging for one is charging for their own service.
A realistic sequence: LLC approved on Monday, error 101 on Tuesday, SS-4 faxed Tuesday afternoon with a return fax number, EIN back the following week. We tell clients to plan around the longer end of the range, especially if a payment processor or US bank account setup is waiting on the number.
How Do I Fill Out Form SS-4 After an Error 101?
Use the same answers you used online. Mismatches between the two create issues later on.
- Line 1: Legal name is exactly as it is in your Articles of Organization.
- Lines 7a and 7b: The person responsible must be a person. Provide their SSN or ITIN. If they don’t have either, put “Foreign.”
- Lines 8a-8c: Confirm it is an LLC, state the number of members, and confirm it was organized in the U.S.
- Line 9a: The entity type depends on how the LLC is taxed. A single-member LLC taxed as a disregarded entity is a different classification from a partnership.
- Lines 10 and 11: The reason for applying is “Started a new business.” State the formation date as the start date.
- Signature: Sign the form. Unsigned forms are sent back.
What Mistakes Do Founders Make With Error 101?
- Retry the form 5-6 times in an hour and hit lockout.
- Renaming the LLC before IRS authorization.
- Faxing SS-4 without a return fax number and waiting on mail.
- The LLC’s typed name differs between the SS-4 and the Articles of Organization.
- Using a person as a responsible party.
- Using a fake SSN. Non-residents should apply by paper or phone.
- Applying for an EIN before the bank can be opened. Most Banks need the IRS Confirmation Letter.
How Can I Avoid Error 101 Next Time?
Search your name plus “LLC” for a few quick seconds before you set it in stone. Don’t just do a name availability check at the state level. If your name is too generic to form a US LLC, add a distinctive word or phrase. There’s no cost to adding a word or phrase before filing, and it costs a lot to change it after filing.
Also, keep your Articles of Organization open while you complete the EIN form. Most of the formatting errors are self-inflicted.
